Plain English again. These terms cover what TinctureTally is, what you can use it for, and what we're each responsible for.
What TinctureTally is
TinctureTally is a free web application for herbalists to manage their dispensary inventory, log prescriptions, and track supplier restocks.
It is not a medical device. It does not provide clinical advice, diagnoses, or treatment recommendations. It is an organisational tool — the professional and clinical judgement behind every formula you make remains entirely yours.
Who can use it
TinctureTally is designed for qualified herbalists and student herbalists for use in their own professional practice. By creating an account, you confirm that you're using it in that capacity.
You must be 18 or over to create an account.
Your account
You're responsible for keeping your login credentials secure. If you think someone else has accessed your account, email us at hello@konfidens.com straight away.
One account per person. Please don't create accounts on behalf of other people.
What you're responsible for
Your clinical decisions. TinctureTally records what you dispense — it doesn't check it. Every formula you make is your professional responsibility. The app's formatted prescription output is a convenience, not a clinical validation.
Your client confidentiality. TinctureTally stores no client information — only the anonymous client IDs you choose to enter. You're responsible for managing the mapping between those IDs and your actual clients, and for keeping that mapping secure in your own records.
The accuracy of your data. Stock levels, cost prices, supplier details — these are only as accurate as what you enter. TinctureTally is a tool; it doesn't audit your dispensary for you.
What we provide
TinctureTally is provided free of charge, as-is, with no guaranteed uptime or service level. We do our best to keep it running reliably, but we can't promise it will always be available, and we're not liable for any disruption to your practice if it isn't.
Because the service is free, our liability to you is limited to the greatest extent permitted by law. We're not responsible for loss of data, loss of income, or any other indirect loss arising from your use of TinctureTally.
Prescription records you create in TinctureTally should also be recorded in your own clinical notes. Don't rely on TinctureTally as your sole record of what you've dispensed.
Acceptable use
Please use TinctureTally for its intended purpose. The following aren't permitted:
- Using the app for anything other than managing your own herbalist practice
- Attempting to access another user's data
- Reverse-engineering, scraping, or otherwise abusing the service
- Using the app to store client personal data (it's not designed for it — and you shouldn't try)
We reserve the right to suspend or terminate accounts that violate these terms or that are being used in a way that's harmful to other users or the service.
Changes to the service
We may add, change, or remove features at any time. We'll do our best to give notice of significant changes, but because TinctureTally is free and actively developed, we can't guarantee stability of specific features.
If we ever decide to wind down TinctureTally, we'll give reasonable notice and provide a way for you to export your data.
Changes to these terms
We may update these terms occasionally. If we make significant changes, we'll let you know by email. Continued use of TinctureTally after an update means you accept the revised terms.
Governing law
These terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts, unless you're a consumer in the UK, in which case UK law and courts apply to you.
